image: Handling Personal Data Handling Personal Data

- There are quite a few legal acts and codes regulating the way we have to handle personal data during recruitment and employment, said Jaanus Kasevits from Raidla Lejins & Norcous Advokaadibüroo, at the April 11th Business Seminar arranged in cooperation with the German-Baltic Chamber of Commerce.

 

- The Personal Data Protection Act (PDPA), the Employment Contracts Act (ECA), the Occupational Health and Safety Act and the Penal Code belong to the Estonian regulations we have to observe, continued Jaanus.

 

- During the recruitment process, the employer may only ask for information having an objective relevance for establishing an employment relationship. Questions on, for example, marital status, religion and hobbies, don’t belong here.

 

- Personal references are often listed in the applicants’ CV’s and in most cases these are contacted by the potential employer. And today social media on the internet are also used to get a background on the applicants. However, the information retrieved in this way should be presented to the applicant so he or she can give their own point of view on the issues. And again, only information being relevant to the job should be used.

 

- Consequently, to protect peoples’ privacy the processing of personal data has a lot of limitations and it is good when both employer and employee know the rules and follow them. You are most welcome to contact me for advice and more information, concluded Jaanus.
